Two dead in dump truck accident, penalty for driver increased

NASHVILLE, Tenn. (WSMV) – Another person was killed in a dump truck accident in Nashville over the weekend, according to the Metro Nashville Police Department.

Police said the passenger of the Ford Focus that crashed Sunday evening on Charlotte Pike, 46-year-old Eduardo Benitez-Alamillo, died Monday afternoon at Vanderbilt University Medical Center.

The MNPD has filed additional charges against 23-year-old Nicholas Sterling of Ashland City. The charge of assault with a vehicle against Sterling will be upgraded to vehicular manslaughter.

The accident occurred around 11 p.m. at the intersection of Charlotte Pike and Old Hickory Boulevard.

According to MNPD, Sterling, the driver of a Freightliner dump truck, was driving south on Old Hickory Boulevard and ran a red light when the light struck the driver’s side of the Ford Focus traveling east on Charlotte Pike.

The driver of the Ford, Kendall Cartwright, 38, of Nashville, died at the scene of the accident, police said.

Investigators said Sterling’s breath smelled of alcohol, and officers who arrived saw an open beer bottle on the floor of the dump truck. Police said they obtained a search warrant for a blood sample from Sterling.

Sterling was also taken to VUMC with minor injuries. Police said he was booked into the Davidson County Jail on $40,000 bail after being released from the hospital. He faces two counts of intoxicated manslaughter.
