Parties argue over validity of cell phone evidence in murder case

On August 9, testimony continued in the case of a 27-year-old murder defendant before Baltimore District Court Judge Yolanda A. Tanner.

Ameer Gittens is charged with first-degree murder, use of a firearm during a serious crime of violence, and possession of a firearm with a conviction in connection with the October 31, 2021, killing of Antwan Andrews.

The first Baltimore Police Department (BPD) officer to arrive on the scene showed body-worn camera footage from the night of the shooting, as well as other evidence found at the scene, including a pair of pants with money in them and bullet casings.

In addition, the analyst who reviewed the cell phone location data testified about tracking information linked to the defendant’s Google account. The prosecution argued that there was a likelihood that Gittens was responsible for the incident because the cell phone tracking information was consistent with the car fleeing the scene after the crime was committed.

However, Gittens’ defense attorney James Sweeting III noted that the analyst had not been informed whether the cellphone tracking information forwarded by police actually came from Gittens.’

Even if the Gmail account belongs to Gittens, there is a chance that someone else had access to it. In addition, Sweeting said the email account allegedly belonging to Gittens was linked to a different recovery phone than the number analyzed.

Maryland District Court documents show Andrews was found with multiple gunshot wounds in the 3500 block of Leeds Street and was pronounced dead at the scene. When Gittens was arrested, an officer found a gun at the Leeds Street crime scene that matched the shell casings.

The afternoon session of the hearing was adjourned for medical reasons.
