A man has been released from custody after authorities say he threatened to kill a deputy sheriff and then put him in a chokehold while resisting arrest at a gas station near Lake Zurich.

Dayon L. Sanders, 36, of Lakemoor was charged with aggravated assault on a law enforcement officer and resisting arrest.

The Lake County Sheriff’s Office responded to a call about an intoxicated person at the Shell gas station on Route 12 and Miller Road in the unincorporated community of Lake Zurich on August 3.

According to Lake County Assistant District Attorney Emma Smoler, a deputy sheriff found the person, identified as Sanders, on the ground near the gas pumps.

Sanders, who was showing signs of intoxication, was slowly waking up as paramedics arrived.

Sanders told deputies he drank 15 shots of liquor and then became agitated, Smoler said.

Officers tried to calm Sanders down, but the man told one of the officers he was going to kill him, Smoler said.

Smoler said Sanders took off his shirt and started beating his chest while shouting “come on” and assuming a fighting stance.

Sanders approached the deputy and the deputy brought the man to the ground to arrest him.

While the two were on the ground, Sanders put the deputy in a chokehold, Smoler said. The deputy suffered abrasions to his hand and knee.

The charges are not liable under the Illinois SAFE-T Act.

Lake County Judge Donna-Jo Vorderstrasse released Sanders after a pretrial hearing. She placed the man in Level 4 custody and ordered him to refrain from consuming alcohol or drugs.

She also ordered that he not have any violent or harassing contact with the police.

A preliminary hearing is scheduled for Tuesday.
