Denmark | New rules on the right to work

The Danish Immigration Service’s new rules for foreigners with a residence permit under the permit procedure are now in force.

Important points:

  • As BAL previously reported, Danish immigration authorities relaxed their guidelines for short-term workers on July 1.
  • As part of the changes, an amendment to the Danish Aliens Act will enable foreigners who have been granted a residence permit under the permit procedure or who already have a valid residence permit under the permit procedure to take up work without applying for a separate work permit for employment for adaptation and training purposes.
  • The change in the directive exempts foreign nationals with a residence permit from the requirement to have a work permit as part of the approval process.
    • The authorization scheme is intended for specially-demanded health personnel such as doctors, dentists and nurses.

Further information: Officials explained that in certain cases, an extension of the permit will also be possible if the applicant is in an employment process for adaptation and training purposes or has been offered employment.

BAL analysis: The government hopes to offer employers and employees more flexibility, help employers recruit highly skilled workers and create more opportunities for short-term employment.
