Idaho governor signs bill to defend women’s sports, fighting Biden-Harris’ Title IX changes to transgender policy

Idaho Governor Brad Little signed an executive order in his state to oppose the Biden-Harris administration’s final rule on Title IX, according to documents obtained by Fox News Digital.

The order is entitled “Law for the Defense of Women’s Sports”.

The executive order directs the Idaho State Board of Education to guarantee two things:

1. Work with the State Department of Education to ensure that Idaho public schools comply with all Idaho laws regarding fairness in women’s sports and continue to educate all public schools on evolving legal challenges regarding the new Title IX rules.

2. Guarantee that every student in Idaho receives the greatest possible equal opportunity in athletics and academics, as guaranteed by the original Title IX rules and Idaho law.

“These girls and women and their families dedicate their time, passion and money to improving their skills and competing to win,” Little told reporters on the steps of the Idaho State Capitol in Boise on Wednesday. “They deserve a level playing field. That’s why it’s so important for us as a state to do everything we can to protect and defend women’s sports.”

“I can fully attest to the unfair composition, the tears I saw not only from the mothers in the stands watching their daughter get destroyed in the sport they once loved, but the tears from the girls who finished ninth and 17th and were one spot shy of being named All Americans,” Gaines said. “I’m very pleased to be here today with these legislators and tell Governor Little that Idaho will not comply.”

The current administration’s final Title IX regulation came into effect this month. Its goal is to protect against discrimination “based on gender stereotypes, sexual orientation, gender identity, and sex characteristics.”

On August 16, the Supreme Court rejected by a vote of 5 to 4 the current administration’s emergency request to enforce parts of a new rule that includes protections against discrimination against transgender students under Title IX.

The request would have permitted biological men in women’s restrooms, locker rooms, and dormitories in ten states where state and local regulations exist to prevent it.

This rule, passed in April, clarified that Title IX’s ban on sex discrimination in schools includes discrimination based on gender identity, sexual orientation and “pregnancy or related circumstances.”

Little’s order is the latest step to push back against the new final rule. More than two dozen Republican attorneys general have sued against the rule, arguing it conflicts with some of their states’ laws that bar transgender students from participating in women’s sports.

The Biden administration insisted that the rule did not affect athletic fitness. Several experts evidence presented to Fox News Digital in June that refuted Biden’s claims.

One incident occurred in West Virginia after it passed the Save Women Sports Act in 2021, which prohibits transgender girls from competing in sports against biological girls. Then a 13-year-old transgender middle school student in West Virginia, known as BPJ, successfully obtained a federal court injunction to be allowed to participate in women’s sports.

“We wanted to prevent sexual harassment of girls in the locker room and prevent women from being pushed off their own teams. Unfortunately, West Virginia’s role was only exposed during the litigation with respect to this one female athlete,” Rachel Rouleau, legal counsel for the Alliance Defending Freedom (ADF), previously told Fox News Digital.

Meanwhile, Gaines is currently in the midst of a court case involving her having to compete against and share a locker room with a biological male at the college level. Gaines has agreed to testify in Georgia about her experience competing against and sharing a locker room with a biological male, Lia Thomas, along with four other NCAA All-American athletes. Fox News Digital previously reported.

Gaines joined Reka Gyorgy, Kylee Alons, Grace Countie and Kaitlynn Wheeler, all members of the Independent Council on Women’s Sports (ICONS), who filed a lawsuit against the National Collegiate Athletics Association (NCAA) in March, accusing the association of knowingly violating Title IX by allowing Thomas to participate.
