Cement truck driver charged with deaths

Dashcam footage of the bus released by the Hays Consolidated Independent School District shows the truck crossing the highway’s center line on Texas 21 before colliding with the school bus.

Hernandez told a Department of Public Safety officer that he smoked marijuana the night before the crash, slept for about three hours and used cocaine around 1:30 a.m., about 12 hours before the crash, an arrest warrant states. He also said he took a 15-minute nap just before the crash before leaving work.

According to an incident report from the Caldwell County Sheriff’s Office, Hernandez told a deputy he fell asleep before the accident.

He later told DPS that an SUV driving in front of him suddenly braked, forcing him to swerve left into the oncoming lane. However, in its accident report, DPS stated there was no evidence of this.

“Driver fatigue may have contributed to the accident,” the DPS accident report states. “Drug use may also have contributed to the accident.”

Manslaughter is a second-degree crime punishable by two to twenty years in prison; involuntary manslaughter is classified as a felony punishable by up to two years in prison and a fine of up to $10,000.

As long as the case is still pending, Goertz declined to comment further.
