Nashville District Attorney’s Office under surveillance over alleged recordings, Attorney General drops case

A new report questions practices within the Davidson County District Attorney’s Office.

The Tennessee Comptroller’s Office and the Tennessee Bureau of Investigation (TBI) are investigating allegations that government employees monitored and monitored audio and video recordings of criminal defense attorneys without their consent. The report says office employees, other building tenants and visitors were also recorded without their knowledge.

According to the state auditor, former office employees claim it was common practice to record defense attorneys while they reviewed evidence in the prosecutor’s examination room.

“These attorneys often discussed confidential information, including statements from their clients, as well as defense strategies,” the report states. Investigators say that after the attorneys left the examination room, “all indications indicate that the notes were then turned over to the assistant district attorney or the secretary of the office unit handling the criminal case.”

This could violate the U.S. Constitution and Tennessee state law.

But the Attorney General’s Office is not filing charges against the Nashville District Attorney – and has dropped the case. Attorney General Jonathan Skrmetti says there are not enough facts to justify prosecution. He did, however, say the recordings were disturbing to him.

“I am particularly concerned about the audio recording feature in places where defense attorneys talk to their clients, especially in the Crimes Against Children Room,” Skrmetti wrote.

The Office of the Auditor General is also investigating why the Attorney General allegedly allowed his staff to participate in campaign activities during work hours that allegedly used state funds to support the Attorney General’s re-election efforts.

The prosecutor’s office released the following statement thanking the Attorney General for dropping the case and denying any wrongdoing:

We thank Attorney General Skrmetti for his prompt response to the Auditor General’s report. This matter is now closed. As General (Glenn) Funk has always stated, neither he nor his office committed crimes or broke laws. This office will continue its mission to support victims, hold perpetrators accountable, and keep Nashville safe.
