“We take every arrest seriously and stand firmly against domestic violence. However, we have an ethical obligation to only file charges when the evidence supports it,” said the Napa County District Attorney. Allison Haley said in a press release received by Us on Tuesday, September 24th.
The prosecutor stated: “We are obligated to prove every criminal charge beyond a reasonable doubt, which is the highest standard in the American criminal justice system. If the available evidence does not meet that level of proof, we cannot ethically bring charges.”
The press release said the decision not to bring charges against 42-year-old Chigvintsev in connection with his arrest in August was made “after a thorough review” of the investigation and an “evaluation of the evidence presented to the prosecutor’s office.”

Us confirmed that Chigvintsev was arrested on August 29 in Napa County, California on domestic violence charges following an alleged incident involving 40-year-old Garcia.
In a 911 emergency call tape obtained from TMZ On August 30, Chigvintsev claimed that Garcia threw a shoe at him and that he needed medical attention. Napa Valley Sheriff’s PIO Henry Wofford told Us after the incident that he “had an opportunity to speak with the victim,” and noted that Chigvintsev “was taken into custody without incident.” The sheriff added, “He did not fight or engage in combat.” Police did not release the victim’s identity.
