A man was shot near Paradise early Sunday morning and the suspect was captured in the Panhandle.

The incident also triggered an Amber Alert for two young children who were later found safe and sound.

Wise County Sheriff Lane Akin said police were called to a home on Private Road 3459 west of Paradise shortly before 4 a.m. about the shooting. The suspect was identified as Jose Diaz-Martinez, 33.

“He was estranged from his wife and he went in and shot her boyfriend,” Akin said. “He was flown to JPS (John Peter Smith Hospital in Fort Worth).”

Preliminary investigations indicate three shots were fired, the sheriff said.

Akin initially had no idea about the condition of the 33-year-old victim, but said it was “obviously serious.”

A BOLO (Be On The Lookout) alert was sent to other law enforcement agencies because Diaz-Martinez was driving a white 2007 Nissan pickup truck northbound on U.S. 81/287, Akin said. The Texas Highway Patrol stopped the vehicle on U.S. 287 near Clarendon in the Texas Panhandle around 8:15 a.m. and Diaz-Martinez was taken into custody and transported to the Donley County Jail.

Two children were initially considered missing and possibly abducted by Diaz-Martinez, prompting an Amber Alert. However, according to Akin, that was not the case and the children were found safe in a nearby home about two hours after the shooting.

WCSO investigators were awaiting a search warrant this morning to gather more evidence in the case. The Texas Rangers are also working on the case.

Further information will be published as soon as it becomes available.
